Court of Appeal on Wednesday in Abuja reserved Nov. 1 for the hearing of an appeal in a no-case submission filed by Mohammed Ndume.
Ndume is standing trial on terrorism related charges at the Federal High Court, Abuja. Justice Amiru Sanusi reserved the date after Mr Rickey Tarfa (SAN), counsel to the applicant, withdrew an earlier motion to stay the trial at the Federal High Court, pending the determination of the appeal.
Sanusi held that the withdrawal of the motion gave the appellate court the power to deal with the substantive appeal. “Already, the parties have filed their briefs in relation to the main appeal; in the circumstance the matter is reserved for Nov.1 for definite hearing,’’ he remarked.
Ndume is also challenging Justice Gabriel Kolawole of the Federal High Court’s decision to admit all the DVDs and 73 call data as evidence to be used against him.
He is accused of sponsoring the Boko Haram sect, and failing to disclose the cell phone number of a spokesman of the sect, Ali Sanda Umar Konduga, which was in his (Ndume’s) possession.
However, Ndume had sought to invalidate the admitted evidence on the ground that the trial judge erred in law when he admitted the non-admissible materials. (NAN)
